This Copyright & DMCA Policy explains how Artycen handles copyright complaints, takedown notices, counter notices, and repeat infringement. Artycen respects the intellectual property rights of creators, copyright owners, and other rights holders.
Users are responsible for ensuring that they have the necessary rights, licenses, permissions, or legal authority to upload, post, display, or share content on Artycen.
1. Respect for Copyright
Artycen is a creative platform. We expect users to respect the creative rights and intellectual property rights of others.
You must not upload, post, distribute, sell, display, or otherwise make available content that infringes another person's copyright, trademark, publicity rights, privacy rights, or other legal rights.
This includes, but is not limited to, unauthorized reposts, stolen artwork, copied illustrations, pirated comics, unauthorized game files, copied fiction, leaked content, paid content shared without permission, or AI-generated content that unlawfully infringes protected works.
2. User Responsibility
By uploading, posting, or sharing content on Artycen, you represent and warrant that you own the content or have the necessary rights, licenses, permissions, or legal authority to use and share it.
You are solely responsible for the content you upload or post on Artycen. Artycen does not assume responsibility for user-submitted content.
If your content includes third-party materials, references, characters, images, text, audio, assets, datasets, or other protected materials, you are responsible for ensuring that your use is lawful.
3. Copyright Complaints
If you believe that content on Artycen infringes your copyright, you may send a copyright complaint or DMCA takedown notice to:

Your notice should include enough information for us to identify the allegedly infringing content and evaluate the complaint.
4. DMCA Takedown Notice Requirements
To submit a DMCA takedown notice, please include the following information:
- Your full legal name or the name of the copyright owner or authorized representative.
- Your contact information, including an email address where we can reach you.
- A description of the copyrighted work that you claim has been infringed.
- The URL or specific location on Artycen where the allegedly infringing content appears.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner.
- Your physical or electronic signature.
Incomplete, inaccurate, or unclear notices may delay our ability to review or act on your request.
5. What Happens After We Receive a Notice
After receiving a copyright complaint or DMCA takedown notice, Artycen may review the notice and take appropriate action at its discretion.
Actions may include removing the content, restricting access to the content, disabling visibility, notifying the user who posted the content, requesting additional information, or taking account-level enforcement action.
Artycen may remove or restrict content without prior notice when we believe doing so is necessary to address copyright concerns, legal risk, policy violations, or platform safety.
6. Counter Notices
If your content was removed or restricted because of a copyright complaint and you believe the removal was mistaken or that you have the right to use the content, you may submit a counter notice.

Your counter notice should include the following information:
- Your full legal name.
- Your contact information, including an email address.
- Identification of the content that was removed or restricted and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief that the content was removed or restricted as a result of mistake or misidentification.
- A statement that you consent to the jurisdiction of the appropriate court for your location, or if you are outside the United States, to the jurisdiction of an appropriate United States court.
- A statement that you will accept service of process from the person who submitted the original notice or their authorized agent.
- Your physical or electronic signature.
7. Restoration of Content
If we receive a valid counter notice, we may forward it to the party who submitted the original copyright complaint.
In appropriate cases, removed or restricted content may be restored unless the original complaining party notifies us that they have filed a legal action seeking to prevent restoration of the content.
Artycen may decide not to restore content if it also violates our Terms of Service, Content Policy, Community Guidelines, applicable law, or other platform rules.
8. Repeat Infringer Policy
Artycen may suspend or terminate accounts of users who repeatedly infringe copyrights or repeatedly upload content that violates the intellectual property rights of others.
Enforcement may include content removal, visibility restrictions, account warnings, temporary suspension, permanent termination, or other appropriate action.
Artycen may consider the number of complaints, the validity of notices, the user's history, the severity of the infringement, repeat behavior, counter notices, legal risk, and other relevant factors.
9. Misuse of the DMCA Process
Users and rights holders must not misuse the copyright complaint or DMCA process.
Misuse may include submitting false claims, fraudulent notices, misleading notices, bad-faith takedown requests, impersonating a rights holder, or using copyright complaints to harass, silence, or punish another user.
Artycen may reject abusive notices, restrict accounts, or take other action against users who misuse the copyright complaint process.
10. Trademark and Other Rights
This Policy primarily addresses copyright complaints and DMCA notices. However, Artycen may also review complaints involving trademarks, publicity rights, privacy rights, impersonation, stolen identity, unauthorized commercial use, or other rights.

11. Fan Works, Parody, Commentary, and Transformative Works
Artycen may host fan works, parody, commentary, criticism, remix, fictional works, or other transformative creative content. However, users are responsible for ensuring that their use of third-party materials complies with applicable law.
Artycen does not determine in advance whether a particular use qualifies as fair use, fair dealing, parody, commentary, criticism, or another legal exception. Users should seek legal advice if they are unsure about their rights.
12. AI-Generated Content and Copyright
AI-generated and AI-assisted content is allowed on Artycen when it complies with our Terms of Service, Content Policy, Community Guidelines, and applicable law.
Users are responsible for ensuring that AI-generated or AI-assisted content does not infringe copyrights, trademarks, publicity rights, privacy rights, or other rights of third parties.
If your content was created, generated, substantially modified, or materially assisted by artificial intelligence tools, you must apply the applicable AI label or AI tag.
13. No Legal Determination
Artycen may remove, restrict, restore, or decline to restore content based on the information available to us. However, Artycen is not a court and does not make final legal determinations about copyright ownership, infringement, fair use, fair dealing, or other legal defenses.
Disputes between users and rights holders may need to be resolved directly between the parties or through appropriate legal processes.
